Section 10 of the Erdman Act of 1898, a federal law, made it a criminal offense for any employer engaged in interstate commerce to discharge an employee because of their membership in a labor union. William Adair, a master mechanic for the Louisville & Nashville Railroad Company, an interstate carrier, discharged a locomotive fireman named O.B. Coppage. The indictment alleged that the sole reason for Coppage’s termination was his membership in a labor organization, the Order of Locomotive Firemen. Adair was convicted in federal district court for violating the statute. He appealed, arguing that the law was an unconstitutional infringement upon personal and property rights guaranteed by the Fifth Amendment and that it exceeded the regulatory power granted to Congress under the Commerce Clause. The Supreme Court granted certiorari to determine the constitutionality of the federal statute.
