Plaintiff Advocacy Center for Persons with Disabilities, Inc., and individual developmentally disabled residents of a group home sued Defendant Woodlands Estates Association, Inc., a homeowners’ association (HOA). The group home, owned by the Upper Pinellas Association for Retarded Citizens (UPARC), was situated in a development governed by the HOA’s Declarations of Covenant and Restrictions. Section 2.01 of these Declarations mandated that lots be used for “residential purposes only” and explicitly prohibited use for “hospital, sanitarium, school, clubhouse, religious, charitable, [or] philanthropic… purposes.” Section 2.25 prohibited activities constituting a nuisance. The HOA, asserting the group home violated these provisions, demanded UPARC not house the Plaintiffs there and subsequently initiated state court proceedings to enforce the Declarations. Plaintiffs filed suit in federal court, alleging the HOA’s actions constituted a failure to provide a reasonable accommodation, thereby violating the Fair Housing Act (FHAA). Both parties moved for summary judgment.
