The personal representatives of three deceased American citizens—Armando Alejandre, Carlos Costa, and Mario De la Peña—sued the Republic of Cuba and the Cuban Air Force. The decedents were members of ‘Brothers to the Rescue,’ a humanitarian organization. On February 24, 1996, they were flying two unarmed civilian Cessna aircraft on a mission to search for rafters in international waters between Florida and Cuba. While flying in international airspace, well outside of Cuba’s twelve-mile territorial sea, the planes were shot down without warning by a Cuban Air Force MiG-29. Radio transcripts revealed that the Cuban pilots identified the planes as civilian aircraft, sought, and received, express authorization from military ground control to destroy them. The attack resulted in the immediate deaths of all four occupants. At the time of the incident, the United States had officially designated Cuba as a state sponsor of terrorism. Cuba refused to appear in court, asserting sovereign immunity via a diplomatic note, which resulted in a default. Pursuant to 28 U.S.C. § 1608(e), which prohibits default judgment against a foreign state without proof of claim, the court held a trial on liability and damages.
