The City of Los Angeles enacted the Citywide Hotel Worker Minimum Wage Ordinance, which established an increased minimum wage of $15.37 per hour, compensated time off, and other requirements for employees at large hotels. The ordinance contained two key features relevant to the dispute. First, it included an opt-out provision, allowing the requirements to be waived through a clear and unambiguous provision in a bona fide collective bargaining agreement (CBA). Second, it provided for a one-year hardship waiver for hotels facing financial distress. The American Hotel & Lodging Association and another hotel group (the Hotels) filed suit, seeking a preliminary injunction to block the ordinance’s enforcement. The Hotels argued that the ordinance as a whole, and its CBA opt-out provision specifically, impermissibly interfered with the labor-management relationship and the collective bargaining process, and was therefore preempted by the National Labor Relations Act (NLRA) under the Machinists preemption doctrine.
