The Mine Safety and Health Administration (MSHA) promulgated regulations via notice-and-comment rulemaking requiring mine operators to report any “diagnosed” occupational illness, including pneumoconiosis. The term “diagnosed” was not defined in the regulation. In response to industry inquiries, MSHA issued a series of Program Policy Letters (PPLs) without notice and comment. The PPLs stated that for reporting purposes, a chest x-ray rating of 1/0 or higher on the International Labor Office (ILO) scale constituted a “diagnosis” of pneumoconiosis. The American Mining Congress, a trade association, challenged the PPLs, arguing they were legislative rules that effectively amended the existing regulation and were therefore invalid because MSHA failed to follow the Administrative Procedure Act’s (APA) notice-and-comment procedures. MSHA defended its actions by asserting that the PPLs were merely interpretive rules, which are exempt from notice-and-comment requirements under APA § 553(b)(3)(A).
