John Haynsworth executed a “February Will” that left the bulk of his $6 million estate to several charities but included a large fee for his attorney, Ted Blum. Shortly thereafter, Blum initiated competency proceedings against Haynsworth. On May 18, 1993, based on medical testimony that Haynsworth was disoriented and suffered from organic brain syndrome, a court adjudicated him totally incapacitated. His niece was appointed guardian. Subsequently, on July 30, 1993, Haynsworth executed a “July Will” that significantly reduced the bequests to the charities and increased the shares for his niece and other family members. After Haynsworth’s death, the niece, as the proponent of the July Will, presented expert testimony from doctors who had not recently examined Haynsworth and lay testimony that he appeared lucid and could make small talk at the time of execution. The trial court found the February Will was the product of undue influence by the attorney, invalidated a later November Will for lack of capacity, and admitted the July Will to probate. The charities appealed.
