Case Brief Summary & Legal Analysis
tl;dr: An FBI agent conducted a warrantless search of a family’s home for a suspect. The Supreme Court held the agent could claim qualified immunity if a reasonable officer could have believed the search was lawful, even if it actually violated the Fourth Amendment.
Legal Significance: This case significantly refined the qualified immunity doctrine, requiring that a constitutional right be “clearly established” in a particularized, fact-specific sense—not just as an abstract principle—for an official to be held liable for its violation.

Case Facts & Court Holding
Key Facts & Case Background
FBI Agent Russell Anderson and other officers conducted a warrantless search of the Creighton family’s home. Anderson believed a fugitive suspected of a recent bank robbery, Vadaain Dixon, was inside. The suspect was not found. The Creightons, who were innocent third parties, filed a Bivens action against Anderson, alleging the search violated their Fourth Amendment rights and seeking money damages. Anderson moved for summary judgment, asserting the defense of qualified immunity. He argued that even if the search was unconstitutional, he was immune from liability because a reasonable officer in his position could have believed the search was lawful, based on a reasonable belief that probable cause and exigent circumstances existed. The District Court granted summary judgment, finding the search was lawful. The Court of Appeals for the Eighth Circuit reversed, holding that unresolved factual disputes precluded summary judgment on the lawfulness of the search. It also held that Anderson was not entitled to qualified immunity because the right to be free from a warrantless search of a home absent probable cause and exigent circumstances was “clearly established.”
