John Dee Andrews (appellant) and Cynthia Mae Andrews (appellee) were engaged and living together when they decided to jointly purchase a house at 2800 Hubbard Circle in Austin to be their marital homestead. They agreed to co-own the property and jointly repay the mortgage. Cynthia signed a loan application at John’s request. However, John unilaterally instructed the closing attorney to remove Cynthia’s name from the title documents, and title issued solely in his name on March 2, 1976. He did not inform Cynthia and told her her presence at closing was unnecessary. They married on March 20, 1976, lived in the house, and treated it as their joint property, using community funds and labor for improvements and mortgage payments. Cynthia discovered the title discrepancy in 1980. John claimed the house as his separate property. The trial court imposed a constructive trust, granting Cynthia a one-half interest, and also ordered John to execute a $45,000 promissory note to Cynthia as part of the community property division.
