Private landowners began clearing approximately 20,000 acres of seasonally flooded bottomland hardwood forest in Louisiana to convert it to soybean cultivation. The process involved using bulldozers with shearing blades to cut vegetation at ground level, raking the debris into windrows for burning, and discing the ashes and stumps into the soil. These activities resulted in the filling of small sloughs and some leveling of the land. The Avoyelles Sportsmen’s League and other environmental groups filed a citizen suit under the Clean Water Act (CWA), alleging the land-clearing constituted an unpermitted discharge of pollutants into waters of the United States. The district court ordered the Environmental Protection Agency (EPA) to make a final wetlands determination. Using a methodology that analyzed vegetation (including facultative hydrophytes), soil, and hydrology, the EPA concluded that 80% of the tract was a wetland. The district court rejected the EPA’s finding, conducted a de novo review, and determined that over 90% of the land was a wetland. The court also held that the land-clearing activities constituted a discharge of pollutants requiring a section 404 permit and were not exempt as normal farming activities. The landowners and federal defendants appealed.
