Plaintiffs, Dr. and Mrs. Baker, owned a farm where Dr. Baker conducted scientific experiments on rabbits and raised other livestock. The defendant, Howard County Hunt, was an unincorporated association that regularly hunted with a pack of fox hounds in the area. On numerous occasions between 1931 and 1936, the pack of hounds trespassed onto the Bakers’ property. The hounds overran the farm, damaged crops, disturbed the rabbits and chickens, and on one occasion, bit Mrs. Baker. After the defendants were notified of the trespasses and the resulting harm, they made no serious effort to prevent recurrences, claiming they did not intentionally hunt on the property. The defendants argued that the hounds would naturally follow a fox wherever it went. On one occasion, Dr. Baker shot several hounds that were in his chicken yard. The Bakers filed suit seeking an injunction to prevent the Hunt and its huntsman from permitting the hounds to trespass on their land. The trial court dismissed the complaint.
