Appellant Kitty Ball obtained a money judgment against Mary Morgan. Ball recorded a certificate of judgment under the name “Mary Morgan.” Prior to the judgment, Morgan had married, becoming Mary Collins. As Mary Collins, she acquired title to a parcel of real property. Collins later sold this property to the appellees, William and Rebecca Vogtner. The Vogtners’ attorney, Mr. Lee, had learned through a casual social conversation two years prior to his representation that Ball might have a judgment against Collins, but he never communicated this to the Vogtners. A title search conducted for the Vogtners under the name “Mary Collins” did not reveal the judgment recorded against “Mary Morgan,” as that name did not appear in the property’s chain of title. The Vogtners purchased the property without any actual knowledge of the judgment. Ball subsequently filed suit to enforce her judgment lien against the property, arguing the Vogtners had constructive notice from the recorded certificate and imputed actual notice through their attorney.
