Plaintiff Barnes, a feeder driver for Defendant UPS for approximately twenty-one years, was terminated for falsification of documents, specifically his Department of Transportation (DOT) card. The terms of his employment were governed by a Collective Bargaining Agreement (CBA) requiring a valid DOT card. Plaintiff admitted to filling in an incorrect expiration date on his DOT card after a physical in May 1999, extending its validity beyond the permissible two years. In June 2002, a supervisor noted the expiration date as August 15, 2002, while UPS records indicated a June 15, 2002 expiration. An investigation revealed the May 19, 1999 physical date, and the physician attested he did not fill in the expiration date. UPS concluded Plaintiff falsified the card, a terminable offense under the CBA. Plaintiff alleged his termination was due to race and that he suffered retaliatory and racial harassment. UPS moved for summary judgment, arguing it had a legitimate, non-discriminatory reason for termination and that the alleged harassment did not meet legal thresholds.
