The appellant, Andrae Barnett, accompanied his brother to the home of his brother’s ex-girlfriend, Daphne Golson. An argument ensued, leading to a physical altercation between the brother and Golson’s new boyfriend, Kevon Moses. A separate altercation then began between Barnett and Moses. Barnett armed himself with a garden hoe. As Moses backed away from Barnett, he tripped and fell onto his stomach. Barnett then struck Moses in the back of the head with the garden hoe, inflicting a fatal blow. Barnett was subsequently indicted and convicted of felony murder under § 13A-6-2(a)(3), Ala. Code 1975. The predicate felony alleged in the indictment was first-degree assault against Moses. Barnett appealed, arguing that the assault was an essential part of the homicide and could not form the basis for a felony-murder charge.
