Jim Barton, a teacher with 19 years of service and tenure status, was employed by the Independent School District No. I-99 to teach driver’s education. He was also certified to teach several other subjects, including industrial arts and biology. Citing budgetary concerns, the school superintendent recommended implementing a reduction-in-force (RIF) plan, which involved eliminating the driver’s education program and non-renewing Barton’s contract. The school board adopted the recommendation. Barton filed suit, alleging the district violated his tenure rights by failing to place him in another position for which he was qualified. He presented evidence that the district could have retained him by rearranging the schedules of other teachers and not renewing a probationary teacher’s contract. The school district argued that neither its collective bargaining agreement nor state law required it to reassign Barton once his specific position was eliminated. The trial court granted summary judgment in favor of the school district, and the Court of Appeals affirmed.
