The plaintiff, Richard Bedor, was injured when the defendant, Michael Johnson, lost control of his vehicle on an icy road, crossed the centerline, and collided with Bedor’s car. The accident occurred on a stretch of road where an ice patch regularly formed in the winter. Johnson, who drove the route regularly, acknowledged he “was aware of the possibility” that ice might be present on the morning of the accident. At trial, there was conflicting evidence as to whether Johnson was speeding or intoxicated prior to losing control. Over Bedor’s objection, the trial court provided the jury with a “sudden emergency” instruction, which states that a person is not negligent if they are placed in a sudden emergency through no fault of their own and act as a reasonably careful person would under similar circumstances. The jury returned a verdict for Johnson, finding him not negligent. The court of appeals affirmed, holding that the ice patch constituted a sudden or unexpected occurrence justifying the instruction.
