The Pittman Underground Water Act of 1919 authorized the federal government to issue land patents in Nevada to encourage agricultural development. Section 8 of the Act required each patent to contain “a reservation to the United States of all the coal and other valuable minerals.” In 1940, the predecessors-in-interest of petitioner BedRoc Limited, LLC, obtained a patent for land containing abundant sand and gravel. At that time, these materials were commercially worthless due to the area’s remote location. By the 1990s, the expansion of Las Vegas created a commercial market for the sand and gravel. When BedRoc began extracting the materials, the Bureau of Land Management (BLM) issued trespass notices, asserting that the sand and gravel were “valuable minerals” owned by the United States. BedRoc filed an action to quiet title to the sand and gravel, arguing the materials were part of the surface estate conveyed by the patent.
