Petitioner Robert Beery represented Richard Coss in a personal injury action, securing a large settlement for Coss, who was paralyzed. Coss, financially unsophisticated, subsequently sought Beery’s advice on investing the settlement funds and also discussed having Beery draft a will. Beery solicited a $35,000 loan from Coss for a satellite company in which Beery was a principal. Beery failed to disclose that the company was in dire financial straits, that the funds were needed to fix a non-functioning installation, that commercial lenders would not provide financing, and the full extent of his own involvement. Beery presented the deal as a “good investment” and only provided a personal guarantee when reminded by Coss. The company failed, and Coss lost his entire investment. Beery never made good on the guarantee. The State Bar initiated disciplinary proceedings, finding Beery violated rules governing business transactions with clients and conflicts of interest.
