Plaintiff Newman, a 67-year-old man, was admitted to the defendant’s nursing home by his nephew. The admission agreement expressly stated that the patient would “not be forced to remain in the nursing home against his will.” Three days after his admission, Newman decided to leave. The nursing home staff prevented his departure by denying him use of a telephone, locking up his clothing, and forcibly returning him when he attempted to walk out. He was then confined to a locked wing with mentally disturbed patients, alcoholics, and drug addicts. Over the next 51 days, Newman attempted to escape five or six times but was caught and forcibly returned on each occasion. As a punitive measure, staff strapped him into a “restraint chair” for hours. The nursing home held Newman without any court order or other legal justification. He eventually escaped and sued for false imprisonment. A jury found for Newman, awarding both actual and exemplary (punitive) damages.
