Defendants Shakil and Shabana Ahmed (“Sellers”) entered into an exclusive one-year listing agreement with Plaintiff Colleen Blondell’s (“Agent”) real estate firm. The Agent introduced the Feketes (“Buyers”) to the property, who made an offer that the Sellers rejected. Shortly thereafter, on April 22, 2013, the Sellers requested to terminate the listing agreement. The Agent sent a standard termination form which explicitly stated it would become effective only when signed by both parties. The Sellers signed and returned the form on April 23. Subsequently, the Sellers began negotiating directly with the Buyers and received a written offer on May 9. With this offer in hand, the Sellers contacted the Agent to finalize the termination, but did not disclose their negotiations or the pending offer. The Agent signed the termination agreement on May 10. The next day, May 11, the Sellers executed the sales contract with the Buyers. The Agent sued for her commission, alleging the termination was procured in bad faith. The trial court granted summary judgment for the Sellers.
