On February 15, 1966, defendant-appellant Burgess signed a document drafted by an agent for plaintiff-appellee, the Board of Control of Eastern Michigan University (EMU). The document purported to grant EMU a 60-day option to purchase Burgess’s home. It included a clause acknowledging receipt by Burgess of “One and no/100 ($1.00) Dollar and other valuable consideration.” However, EMU conceded that neither the one dollar nor any other consideration was ever paid or tendered to Burgess. On April 14, 1966, within the 60-day period, EMU delivered written notice to exercise the option. Burgess rejected the subsequent tender of the purchase price, and EMU sued for specific performance. Burgess testified that she had telephoned EMU’s agent hours after signing the document to revoke her offer, a claim the agent denied. The trial court granted specific performance, holding that the written acknowledgment of consideration estopped Burgess from claiming it was not paid.
