During a softball game, defendant Adrien Duplechin was a baserunner advancing to second. Plaintiff Jerome Bourque, the second baseman, received a throw, tagged the base for a force-out, and then stepped approximately five feet away from the base and out of the base path to throw to first base to complete a double play. After Bourque had released the ball, Duplechin, who was significantly larger than Bourque, ran at full speed directly into Bourque instead of proceeding to the base. Duplechin did not slide but remained upright, striking Bourque under the chin with his arm and causing severe jaw and dental injuries. Duplechin admitted he intended to run into Bourque to prevent the double play but testified he did not intend to cause the specific injuries. An umpire ejected Duplechin from the game for a flagrant rules violation. Expert testimony confirmed that softball is a non-contact sport and the accepted method to break up a double play is by sliding.
