David Boyle, a U.S. Marine co-pilot, died when his CH-53D helicopter crashed during a training exercise. Although he survived the impact, he drowned because he could not escape the submerged aircraft. His father sued the helicopter’s manufacturer, United Technologies Corp. (Sikorsky), in diversity, alleging under Virginia tort law a design defect in the copilot’s emergency escape system. Specifically, the plaintiff claimed the escape hatch opened outward, rendering it ineffective against water pressure, and that access to the handle was obstructed. The helicopter was built for the United States pursuant to a government contract that included detailed specifications for the escape hatch system, which Sikorsky followed.
