Petitioners were indicted on seven separate counts of conspiracy, each count charging an agreement to violate a different provision of the Internal Revenue Code related to the illicit manufacture and distribution of distilled spirits. At trial, the evidence demonstrated that the petitioners had engaged in a single, ongoing collaboration to commit all the specified unlawful acts. The government conceded that the proof established only one continuous agreement. Nevertheless, the trial court, accepting the government’s theory, instructed the jury that a single agreement with multiple illegal objects could support convictions for multiple conspiracies.
