Republic Creosoting Company seasoned railroad ties. A new employee, Raymond Davis, was on his fourth day of employment. A supervisor had explicitly instructed Davis “not to get around no trucks; the unloader done all the unloading.” An unloader operator later invited Davis to the unloading area to sort ties after the unloading was complete. Davis had never witnessed the unloading process. The standard, safe procedure involved a forklift supporting a package of ties before a worker cut the steel band securing them. On the day of the incident, after the truck’s main chains were removed but before the forklift was in position, Davis, without any order and contrary to his instructions, approached the truck and cut a steel band with an ax. Several ties, weighing 150-235 pounds each, fell and fatally injured him. The Secretary of Labor cited Republic for a serious violation of OSHA’s general duty clause for failing to properly instruct the employee. A second citation was issued for maintaining unstable piles of ties without barricades or warnings. The Occupational Safety and Health Review Commission (OSHRC) reviewed the case and vacated both citations. The Secretary of Labor appealed.
