Latasha Reed rented a Ford Fusion in New Jersey, listing no additional drivers on the rental agreement, which prohibited unauthorized drivers. Immediately after, she gave the keys to petitioner Terrence Byrd, who was waiting outside. Byrd, the sole occupant, drove the car toward Pennsylvania. State troopers stopped Byrd for a minor traffic infraction. Upon learning that the car was rented and Byrd was not an authorized driver, the troopers stated they did not need his consent to search the vehicle. Byrd admitted to having a marijuana cigarette in the car. The troopers proceeded to search the passenger compartment and the trunk, where they found body armor and 49 bricks of heroin inside a laundry bag. At trial, Byrd moved to suppress the evidence, arguing the search violated his Fourth Amendment rights. The District Court denied the motion, and the Third Circuit affirmed, holding that as an unauthorized driver, Byrd lacked a reasonable expectation of privacy in the rental car and therefore could not challenge the search.
