Plaintiffs (Cantrelles) and defendants (Gaude/Melancon) were adjacent landowners. The property in dispute was a portion of a 40-foot wide street, Upperline Street, which was dedicated for public use in 1913 but never constructed. In 1955, a parish ordinance formally abandoned the street, but the ordinance was never recorded. By operation of law, the abandoned property should have reverted equally to the contiguous landowners. However, in 1982, the Cantrelles’ ancestor-in-title, Schieffler, acquired a quitclaim deed from the heirs of the original dedicator that purported to convey the entire 40-foot strip. The Cantrelles acquired the property from Schieffler in 1990. The Cantrelles fenced most of the property but left a 7-foot wide ‘alleyway’ open, which is part of the disputed land. Both parties used the alleyway until the Cantrelles blocked it. The defendants’ property fronted a bayou and had no other land access to a public road, making it an enclosed estate without use of the alleyway.
