A 40-foot public road, Upperline Street, was dedicated in 1913. In 1955, a parish ordinance formally abandoned a portion of the street, which was never constructed. Under Louisiana statute (LSA-R.S. 48:701), upon abandonment, the land should have reverted to the contiguous landowners, with each receiving half (20 feet). The ancestors of both plaintiffs (Cantrelles) and defendants (Gaudes) were contiguous landowners. However, in 1982, the plaintiffs’ predecessor in title, the Fisher heirs, purported to sell the entire 40-foot abandoned strip via quitclaim deed to Mrs. Schieffler. Schieffler possessed the property, fencing most of it but leaving a 7-foot strip as an unfenced alleyway. In 1990, Schieffler sold the property, as described in the 1982 deed, to the plaintiffs. The plaintiffs later blocked the alleyway, leading to this suit to establish ownership. The defendants argued the 1955 ordinance was invalid because it was unrecorded and that the property should be divided, as they were entitled to their 20-foot share.
