Defendant ReDigi Inc. operated an online marketplace for what it termed “pre-owned” digital music files. To sell a song, a user had to download ReDigi’s “Media Manager” software, which would verify that the music file was lawfully purchased from iTunes. The user would then upload the file to ReDigi’s remote server, the “Cloud Locker.” ReDigi claimed its technology “migrated” the file packet-by-packet, ensuring the file did not exist in two places at once and deleting the original from the user’s computer. Once on the server, the file could be sold to another user, who would then download it. ReDigi took a percentage of the proceeds from each sale. Plaintiff Capitol Records, LLC, which owned the copyrights to many songs sold on the platform, sued ReDigi for direct and secondary copyright infringement, alleging violations of its exclusive rights of reproduction and distribution under the Copyright Act. Both parties moved for summary judgment.
