Plaintiff Ernest Castaneda, a resident of a mobilehome park owned by defendant Olsher, was shot and injured as an innocent bystander during a gang confrontation. The shooter was a guest of Paul Levario, a tenant who lived across the street from the plaintiff and was a suspected gang member. Prior to the shooting, the park experienced ongoing problems with gang graffiti, suspected drug dealing, and other crimes. There were two prior shooting incidents: one where a bullet from an unknown source hit a mobilehome, and another involving a gang fight on an adjacent property where a different park resident was arrested. The park manager knew Levario and his associates were suspected gang members and had received complaints about them. These complaints included harassing plaintiff’s sister, intimidating another tenant with a pit bull, and possibly breaking car windows. Plaintiff’s grandmother had complained to the manager about gang members, and the manager relayed that the owner, Olsher, told her to rent to them because “their money is as good as yours.” Plaintiff argued these facts made the shooting foreseeable, creating a duty for the landlord to act.
