Adolfo Suarez (“Decedent”) was shot and killed in his home. His widow, Luz Ballesteros-Suarez (“Mrs. Suarez”), was a suspect in the murder and the named beneficiary on one of his two life insurance policies. The change-of-beneficiary form for the second policy, which also named her, was later found to be a forgery. The insurance companies filed interpleader actions to determine the proper recipient of the proceeds. At a civil bench trial, Mrs. Suarez invoked her Fifth Amendment right against self-incrimination when questioned about her involvement in her husband’s death. The trial court considered circumstantial evidence, including a detective’s testimony implicating her, the forged beneficiary form, and testimony that she had attempted to bribe the decedent’s sister.
