Patricia Hamilton, who suffered from Crohn’s disease, was prescribed the drug Remicade by her gastroenterologist, Dr. Hauptman. Both Dr. Hauptman and a subsequent prescribing physician, Dr. Pop-Moody, were aware that Remicade carried a rare risk of causing lupus-like syndrome, a side effect disclosed in the manufacturer Centocor’s FDA-approved package insert. After receiving Remicade infusions, Hamilton developed the syndrome. During her first infusion, administered at a separate clinic, Hamilton was shown an informational video produced by Centocor that did not mention the risk of lupus-like syndrome. Hamilton sued Centocor, framing her claims as fraud and misrepresentation, and arguing the video constituted direct-to-consumer (DTC) advertising that created a direct duty for Centocor to warn her.
