The Building Code Board of Appeals of the City of Cheyenne (the Board), a municipal administrative agency, conducted a public contested case hearing under the Wyoming Administrative Procedures Act (WAPA) regarding an appeal of denied demolition permits. Following the public hearing, the Board convened in private on two separate occasions to conduct what it termed “quasi-judicial” deliberations. Subsequently, the Board held a public meeting where it briefly discussed its prior deliberations and then formally voted to adopt a pre-drafted, 19-page written decision affirming the permit denials. Cheyenne Newspapers, Inc. (the Newspaper) filed suit, alleging the private deliberations violated the Wyoming Public Meetings Act (the Act) and seeking a declaratory judgment that the Board’s final decision was null and void. The district court granted summary judgment for the Board, finding the Act did not apply to quasi-judicial deliberations. The Newspaper appealed to the Wyoming Supreme Court.
