James Goodwin, an 80-year-old man with considerable real estate holdings, married Wesley Foust-Graham, his 40-year-old real estate broker, in April 2002. In the months prior, Foust-Graham had become Goodwin’s caregiver, spending up to twelve hours a day with him and isolating him from others. Evidence suggested Goodwin was suffering from dementia and Alzheimer’s disease. On the wedding day, Goodwin called an acquaintance, claiming he was being locked up and needed help. At the magistrate’s office, Goodwin appeared confused and, despite a history of expressing racist views, married Foust-Graham, who is African-American. Foust-Graham told the witnesses not to inform Goodwin’s family. Before Goodwin’s death in October 2003, his daughter, Kelly Clark, initiated an annulment action as his guardian ad litem. After his death, Clark was substituted as plaintiff in her capacity as executrix of Goodwin’s estate.
