Plaintiffs Jose and Dilia Colmenares were riding an escalator at an airport operated by the Puerto Rico Ports Authority (Ports Authority). The moving handrail suddenly stopped while the steps continued to ascend. This caused Mrs. Colmenares to lose her balance. Her husband, in preventing her fall, lost his own balance and tumbled down the escalator, sustaining injuries. The plaintiffs sued the Ports Authority’s insurer, Sun Alliance Insurance Company. The Ports Authority had a maintenance contract with Westinghouse Electric Corporation, which required Westinghouse to inspect, maintain, and repair the escalator.
