The defendant, Britto Brown, was not present during a fatal home invasion and attempted armed robbery. However, in his apartment, he provided one of the perpetrators with a .380 pistol and gave hooded sweatshirts to three of the men to conceal their identities. Brown was aware that the men were planning to rob two “pretty big guys.” During the robbery, one of the perpetrators, armed with a different gun, shot and killed two victims. Brown’s gun was also present at the scene, wielded by another perpetrator. After the killings, the perpetrators returned to Brown’s apartment, where he retrieved his gun. Brown was subsequently charged with two counts of felony-murder on a theory of accomplice liability, with the predicate felonies being attempted armed robbery and home invasion.
