The defendant, Michael Mochan, made numerous unsolicited telephone calls to Louise Zivkovich, a married woman with whom he had no prior acquaintance, over a period of more than one month. The calls occurred at all hours of the day and night. During these calls, Mochan used obscene, lewd, and filthy language, suggesting sexual intercourse and sodomy. The calls were made from a four-party telephone line, creating the potential for others to overhear. Members of Zivkovich’s household did, in fact, hear some of the defendant’s language. The defendant’s conduct was not proscribed by any existing Pennsylvania statute. After being identified with the assistance of the telephone company, Mochan was arrested and charged under two indictments for a common law offense described as “Immoral Practices and Conduct.” He was tried by a judge without a jury and convicted on both charges. He appealed, arguing that his actions did not constitute a crime at common law.
