The victim, a nurse, attended a party hosted by the defendant, Dr. Sherry. The victim knew Sherry professionally but was not acquainted with the other two defendants, Drs. Hussain and Lefkowitz. During the party, Hussain and Sherry grabbed the victim by the arms and pulled her out of the apartment, stating they were going to Rockport. The victim verbally protested but did not physically resist, initially believing they were joking. Hussain carried her over his shoulder to a car and held her in the front seat. Upon arriving at Lefkowitz’s house, she asked to be taken home, but Hussain carried her inside. In a bedroom, the three men began to disrobe. The victim, now frightened, verbally protested as the men undressed her and placed her on the bed. She testified that she felt “physically numbed and could not fight.” Each defendant then had intercourse with her separately while the other two waited in an adjacent room.
