Plaintiff’s counsel in a personal injury lawsuit retained James Green, a forensic engineer, as a consulting expert. Counsel paid Green a retainer and provided him with a binder containing confidential materials, including attorney work product reflecting litigation strategy, witness interviews, and mental impressions. Green performed 27 hours of work and provided an oral opinion before a billing dispute led to his resignation. Shortly thereafter, defense counsel from the firm Marshall, Dennehey, Warner, Coleman & Goggin contacted and retained Green for the same case. Defense counsel was aware of Green’s prior engagement with the plaintiff but proceeded to hire him.
