Plaintiff’s counsel in a personal injury lawsuit retained James Green, a forensic engineer, as a consulting expert. Counsel paid Green a retainer and provided him with a binder containing confidential materials, including attorney work product reflecting litigation strategy, witness interviews, and mental impressions. Green performed 27 hours of work and provided an oral opinion before a billing dispute led to his resignation. Shortly thereafter, defense counsel from the firm Marshall, Dennehey, Warner, Coleman & Goggin contacted and retained Green for the same case. Defense counsel was aware of Green’s prior engagement with the plaintiff but proceeded to hire him. The court found that defense counsel’s testimony regarding their knowledge of the prior relationship was contradictory and that their conduct was “wanting.” Upon learning that Green was working for the defendant, plaintiff’s counsel moved to disqualify both Green and the entire defense firm.
