A Nevada statute from 1865 imposed a “capitation tax of one dollar upon every person leaving the State” by railroad or stagecoach. The law mandated that operators of these common carriers collect the tax from each passenger and remit it to the state. Crandall, an agent for a stagecoach company, was arrested and held in custody after he refused to report and pay the taxes for passengers his company transported out of Nevada. He challenged the statute’s constitutionality, arguing that it infringed upon powers of the federal government and the rights of citizens. The Supreme Court of Nevada upheld the law, finding it did not violate the Commerce Clause or the Import-Export Clause of the U.S. Constitution. Crandall then brought the case to the U.S. Supreme Court to determine whether a state has the power to tax individuals for the privilege of passing through or leaving its territory.
