Berg Lumber Company (Berg) owned a Caterpillar road grader. In late 1991, Joe Crail, a contractor for Berg, took the grader without Berg’s permission to Richard Cross’s ranch to perform work. Upon learning this, Berg contacted Crail, who promised its return. Later, Berg found the grader at Cross’s ranch. Cross requested to use the grader to repair damage Crail had caused to his property. Berg agreed, telling Cross he would retrieve it after the repairs. Despite Berg’s attempts to reclaim the grader in 1992 and 1993, Cross retained it, citing ongoing repairs or other excuses. In June 1994, Cross refused Berg’s employees access to retrieve the grader. In the summer of 1996, Cross falsely told Berg’s agent the grader was gone, claiming someone had hauled it away. Berg’s agent then discovered the grader concealed on Cross’s property via an aerial search. Berg formally demanded its return on October 9, 1996. Berg filed suit for conversion and replevin on January 5, 1998. The district court found for Berg, awarding damages including $67,500 for loss of use, and ordered the grader’s return. Cross appealed.
