A key covenant stated, “No more than one dwelling shall be erected on any one lot and all such dwellings shall be limited to not more than two families.” The Romriells planned to convert the existing single-family residence into an eight-bedroom, eight-bath facility to operate as a commercial group home for up to eight unrelated elderly adults. After D & M and the homeowners formally rejected their proposal for an exception to the covenants, the Romriells began remodeling anyway. They argued that Idaho Code §§ 67-6530 and 67-6531, which declare that a group home for eight or fewer elderly persons is a residential use for zoning purposes, rendered the private covenant unenforceable as against public policy. D & M filed suit and obtained a permanent injunction preventing the construction and operation of the group home. The Romriells appealed.
