Blizzard Entertainment (Plaintiff) developed popular computer games that included an exclusive online multiplayer service called Battle.net. To access Battle.net, a user’s legitimate copy of the game, authenticated by a unique CD Key, would perform a “secret handshake” with Blizzard’s servers. This process was a technological protection measure (TPM) to control access to the copyrighted online components of the game. All users were required to accept the terms of an End User License Agreement (EULA) and Terms of Use (TOU) before installing or playing online. These agreements expressly prohibited reverse engineering, decompiling, or creating derivative works. The defendants, a group of programmers, reverse-engineered Blizzard’s authentication protocol to create “bnetd.org,” a server emulator that mimicked Battle.net. They distributed this software for free, allowing users to play Blizzard’s games online without connecting to Battle.net. The bnetd.org emulator intentionally bypassed the CD Key verification process, which permitted users with unauthorized or pirated copies of the games to play online. Blizzard sued for, among other things, breach of contract and violations of the Digital Millennium Copyright Act (DMCA).
