Del Lago’s bar staff observed this continuous and intensifying antagonism but took no action to de-escalate the situation, call security, or stop serving alcohol to the belligerent patrons. Unlike the previous night when security had been present and removed an unruly patron, no security was present in the bar during this period. At closing time, the staff funneled the hostile groups toward a single exit, at which point a melee involving 20 to 40 people erupted. Smith entered the fight to rescue a friend and was assaulted by an unknown person, resulting in a skull fracture and brain damage. The jury found Del Lago 51% responsible.
