Dimmitt Chevrolet, Inc. (“Dimmitt”), an auto dealership, sold its used crankcase oil to Peak Oil Company (“Peak”) from 1974 to 1979. Peak’s oil recycling operations caused extensive, long-term soil and groundwater pollution at its plant site. The contamination resulted primarily from Peak’s practice of placing waste oil sludge in unlined storage ponds, allowing chemicals to leach into the ground over many years. Additional pollution stemmed from routine oil spills, leaks, and contaminated rainwater runoff. In 1987, the Environmental Protection Agency (EPA) identified Dimmitt as a potentially responsible party (PRP) for cleanup costs under the Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA). Dimmitt sought defense and indemnification from its insurer, Southeastern Fidelity Insurance Corporation (“Southeastern”), under its comprehensive general liability (CGL) policies. The policies covered property damage caused by an “occurrence” but contained a pollution exclusion clause. This clause barred coverage for pollution damage unless the “discharge, dispersal, release or escape is sudden and accidental.” Southeastern filed a declaratory action, arguing the gradual pollution at the Peak site was not “sudden and accidental” and thus was not covered.
