In 1972, Helen Downing conveyed her farm to herself and her son, John Robert Downing, “as joint tenants, their heirs and assigns, forever in fee simple.” An existing oral agreement allowed a farmer to cultivate the land, and with John Jr.’s consent, Helen continued to receive all rent payments. In 1985, Helen and John Jr. jointly executed a mortgage on the property. After Helen died in 1987, her will left the residue of her estate to be divided between John Jr. and her daughter, Bonnie Downing. Bonnie, as personal representative of the estate, filed a complaint seeking a declaration that the 1972 deed created a tenancy in common, not a joint tenancy. If construed as a tenancy in common, a one-half interest in the farm would pass through Helen’s estate. The circuit court found that a joint tenancy was created but was subsequently severed by the mortgage, creating a tenancy in common. John Jr. appealed.
