Plaintiff Duane Reade, Inc. operated a drugstore in the World Trade Center (WTC) concourse, which was destroyed in the September 11, 2001 attacks. Duane Reade held an insurance policy from defendant St. Paul Fire & Marine Insurance Co. that covered property loss and business interruption. St. Paul paid the property loss claim but disputed the scope of the business interruption coverage. The policy covered the “actual loss of Business Income” during the “period of restoration.” The “Restoration Period” was defined as the time it would take with reasonable speed to repair or replace the damaged “property.” Duane Reade argued this period should extend until the entire WTC complex is rebuilt.
