Case Brief Summary & Legal Analysis

General Brief
4 min read

tl;dr: A photography studio fired a deaf employee, asserting that verbal communication was an essential job function. The court agreed, holding that because she could not perform this essential function, with or without accommodation, she was not a “qualified individual” under the Americans with Disabilities Act (ADA).

Legal Significance: This case demonstrates judicial deference to an employer’s judgment in defining essential job functions, particularly in customer-facing roles, and clarifies that an employer is not required to eliminate an essential function as a form of reasonable accommodation under the ADA.

Case Facts & Court Holding

Key Facts & Case Background

Jessica Chrysler, a profoundly deaf individual, was hired by The Picture People, Inc. as a “performer,” a role involving customer intake, sales, photography, and lab duties. The written job description listed “strong verbal communication skills” as a qualification. Chrysler communicated non-verbally through writing, gestures, and miming. The employer’s business model involved fast-paced, 20-minute photo sessions, often with young children. Management found Chrysler’s non-verbal communication methods to be “awkward, cumbersome, and impractical” for customer interactions and reassigned her primarily to lab work. After the busy holiday season, the studio shifted to a “2-2 staff coverage” model, requiring each performer to be capable of all four job functions. Because management determined Chrysler could not effectively perform the customer-facing duties of intake, sales, and photography, her hours were eliminated. After she complained and threatened to file a grievance, she received a disciplinary notice and was later terminated. The EEOC sued on her behalf, alleging disability discrimination and retaliation under the ADA.
