Escondido Mutual Water Co. operated a hydroelectric project with facilities, including a canal and diversion dam, located on three Mission Indian Reservations in California. The project also diverted water from the San Luis Rey River, affecting three other downstream reservations that did not contain any project works. Upon application for a new 30-year license, the Secretary of the Interior submitted a list of conditions he deemed necessary for the adequate protection of all six reservations. The Federal Energy Regulatory Commission (FERC) asserted its ultimate authority under the Federal Power Act (FPA), rejecting or modifying many of the Secretary’s proposed conditions. FERC also determined that its protective obligations under § 4(e) of the FPA extended only to the three reservations physically occupied by the project facilities. Furthermore, FERC rejected the argument by the Indian Bands that § 8 of the Mission Indian Relief Act of 1891 (MIRA) required their consent before a license could be issued for facilities on their lands. The Court of Appeals for the Ninth Circuit reversed, holding that FERC must accept all of the Secretary’s conditions for all six reservations and that tribal consent was required.
