In 1961, Hector Skifter assigned all his interest in nine life insurance policies on his life to his wife, Naomi, retaining no interest or power over them. Naomi predeceased Skifter, leaving a will that placed her residuary estate, including these policies, into a trust. The trust income was payable to their daughter for life, with remainder to others. Naomi appointed Skifter as trustee, granting him broad discretionary powers, including the power to pay over the entire principal to the current income beneficiary, even if it terminated the trust, and broad management powers. Skifter could not, however, exercise these powers for his own economic benefit or alter the beneficiaries. Upon Skifter’s death in 1964, the Commissioner of Internal Revenue (C.I.R.) contended that Skifter’s trustee powers constituted “incidents of ownership” under § 2042(2), requiring inclusion of the policy proceeds in his gross estate.
