Milburn Wilson (decedent) and Ruth Wilson (surviving spouse) were married. During the marriage, the decedent used community property funds to open several “Totten trust” bank accounts, naming himself as trustee for his children from a prior relationship as beneficiaries. The surviving spouse was unaware of these accounts until after the decedent’s death. The decedent died intestate. The children’s trust accounts totaled approximately $131,500. The surviving spouse filed a community property petition, claiming a one-half interest in the funds held in the children’s trust accounts as her share of the community property. The children objected, arguing that the funds in their accounts constituted less than half of the total community estate and that the decedent had the right to dispose of his one-half share of the community property “as a whole.” They contended that since the surviving spouse was already receiving more than half of the total community property, she was not entitled to any portion of their specific trust accounts.
